These Terms of Service, together with any other rules or policies posted on our site (collectively, the “TOS”), form an agreement between Italian Candy Shop LLC (“Italian Candy Shop,” “we,” “our,” “us”) and you, the visitor, governing your access to and use of the ItalianCandy.Shop website, including all content, features, and services made available through it (collectively, the “Site”).
By visiting the Site, placing an order, or creating an account, you accept and agree to be bound by this TOS. We may update this TOS from time to time, and your continued use of the Site after any such change means you accept the revised terms. We recommend checking this page periodically, since we are not obligated to notify you individually of changes. If you do not agree to this TOS, or to any future changes, you should stop using the Site.
Registration
You do not need an account to browse the Site, but you will need to register to place an order or use certain features. When you register, you agree to provide information about yourself that is true, accurate, current, and complete, and to keep that information up to date if it changes.
You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us right away if you suspect any unauthorized use of your account or any other breach of security. Italian Candy Shop is not responsible for losses caused by unauthorized use of your account, though you may be held responsible for losses we or others incur as a result of such use. Eligibility to Purchase
To place an order through the Site, you must be able to form a legally binding contract under applicable law. You must provide your real name, a valid email address, and any other information reasonably requested to complete an order, along with payment details that are accurate and that you are authorized to use.
We reserve the right to limit the quantity of any item purchased by a single customer or shipped to a single address, and to decline any order at our discretion, including where we suspect fraud, abuse, or a violation of this TOS.
Orders
All orders are subject to acceptance and product availability. Adding an item to your cart does not reserve it, and it remains available to other customers until your order is placed and payment is received.
We stock most items ourselves, but because much of our candy is imported from Italy, certain products may occasionally be back-ordered while we wait on a shipment from a supplier. If an item you ordered becomes unavailable after your order is placed, we will notify you by email and refund any amount charged for that item within a reasonable time.
We keep a record of your order history for as long as reasonably necessary for accounting, tax, and customer service purposes.
Pricing
Prices on the Site are listed in US Dollars and do not include applicable taxes or shipping costs, which are calculated and displayed at checkout. Sales tax is charged based on your shipping address and the laws of the state or jurisdiction to which your order is shipped. We make reasonable efforts to keep pricing accurate and current, but in the event of a pricing error, we reserve the right to cancel the order and refund any amount paid.
Order Acceptance
After you place an order, you will receive an email confirming that we received it. This confirmation is not an acceptance of your order, only an acknowledgment. Our acceptance of your order, and the contract between you and Italian Candy Shop, is completed when we ship your order, at which point you will receive a second email with tracking information.
We reserve the right to decline or cancel an order for any reason, including if payment cannot be authorized, if an item is out of stock or fails a quality check, or if we believe an order was placed in error or in violation of this TOS. If we cancel an order after payment has been taken, we will issue a full refund for the affected items.
Payment
We accept major credit and debit cards, along with any other payment methods indicated at checkout. Payment is authorized when you place your order and is charged when your order ships. By submitting payment information, you confirm that you are authorized to use the payment method provided.
All transactions on the Site are processed through an encrypted, secure payment gateway. We do not store your full card details on our own systems. If your card issuer declines authorization for any reason, we are not responsible for any resulting delay in processing or shipping your order.
Shipping and Delivery
We aim to ship orders within 2 business days after your order has been processed. Estimated delivery times shown at checkout are estimates only and begin from the date of shipment, not the date of order. We are not responsible for delays caused by the carrier, weather, or other events outside our control.
Because our candy is a food product, some items are sensitive to heat and can be affected by high temperatures during transit, particularly anything containing chocolate. During warmer months, we may recommend or require expedited shipping for certain products, and we are not responsible for melting or quality loss caused by extreme heat once a package has left our facility, provided the item was properly packaged before shipment. If your order arrives visibly damaged or melted due to a shipping issue on our end, contact us and we will work with you on a resolution.
Returns and Refunds
In compliance with Food & Drug Administration (FDA) policies, and because candy is a perishable item, we are not able to accept any returns.
If you receive incorrect items in your order, please contact us within 7 days of delivery with a description and, if possible, a photo, and we will arrange a replacement for you.
We do not currently offer product exchanges. If you would like a different item than the one you ordered, please place a new order separately.
Allergen and Ingredient Information
Many of our products are made in facilities that also process milk, tree nuts, peanuts, soy, wheat, egg, and other common allergens, and cross-contact is possible even where a specific allergen is not listed as an ingredient. If you have a food allergy or intolerance, please review the ingredient and allergen information provided on each product page carefully before ordering, and do not rely solely on the product name or category.
Because our candy is imported from Italy, ingredient and allergen information on our Site is translated and adapted from the manufacturer's original labeling, and packaging you receive may include the original Italian language label in addition to, or instead of, an English translation. We make reasonable efforts to keep this information accurate and current, but manufacturers can change recipes or sourcing without notifying us, so we recommend checking the physical packaging upon arrival if you have a serious allergy. We are not liable for allergic reactions or other adverse effects resulting from consumption of products purchased through the Site.
Product Descriptions and Images
We try to describe and photograph our products accurately, including flavor, ingredients, and packaging, but colors, packaging design, and net weights can vary between production batches and by manufacturer, and may differ slightly from what is shown on the Site. We do not guarantee that your device's display will render product colors with complete accuracy. If a product you receive differs materially from its description, contact us and we will make it right.
Promotional Codes
Promotional and discount codes are non-transferable, have no cash value, and cannot be combined with any other promotional code or offer unless expressly stated. Codes must be used by any expiration date provided and may be limited to one use per customer at our discretion.
Intellectual Property
All content on the Site, including text, graphics, logos, product photography, and the overall look and feel of the Site, is owned by Italian Candy Shop LLC or its licensors and is protected by copyright, trademark, and other applicable laws. You may view and download content from the Site for your own personal, non-commercial use, but you may not copy, reproduce, republish, or distribute any content from the Site without our prior written permission. Product names, brand names, and trademarks belonging to the manufacturers whose candy we sell remain the property of those manufacturers.
User Conduct
You are responsible for your own use of the Site and for any account activity that occurs under your login. You agree not to use the Site for any unlawful purpose, to interfere with the Site's operation or security, to attempt to gain unauthorized access to any part of the Site, or to collect information about other users without their consent.
We may suspend or terminate your access to the Site, or to your account, at any time and without notice, if we believe in good faith that you have violated this TOS or used the Site in a way that could harm us, other customers, or third parties.
Third-Party Links
The Site may contain links to third-party websites that are not operated by us. We have not reviewed these sites and are not responsible for their content, accuracy, or privacy practices. Including a link does not mean we endorse the linked site, and your use of any third-party website is at your own risk.
Disclaimer of Warranties
The Site and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. Nothing in this section is intended to limit any warranty or right you have under applicable consumer protection law that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Italian Candy Shop LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or your purchase of any product, including lost profits or lost data, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from your use of the Site or a purchase made through it will not exceed the amount you paid for the product or order giving rise to the claim. This limitation does not apply to liability that cannot be limited or excluded under applicable law, such as liability for death or personal injury caused by our negligence.
Indemnification
You agree to defend, indemnify, and hold harmless Italian Candy Shop LLC, its officers, members, employees, and agents from any claim, liability, damage, or expense, including reasonable attorneys' fees, arising out of your breach of this TOS, your misuse of the Site, or your violation of any law or the rights of a third party.
Copyright Complaints
If you believe content on the Site infringes your copyright, you may send a notice to our Copyright Agent that includes: a signature of the person authorized to act on behalf of the copyright owner; identification of the copyrighted work claimed to be infringed; identification of the material you claim is infringing, with enough detail for us to locate it; your contact information; a statement that you have a good faith belief the use is not authorized; and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

General Terms
Entire Agreement: This TOS is the complete agreement between you and Italian Candy Shop LLC regarding your use of the Site and replaces any prior agreements or understandings between us on that subject.
Changes to the Site: We may change, suspend, or discontinue any part of the Site or the products we offer at any time, without prior notice and without liability to you.
No Waiver: If we do not enforce any provision of this TOS on a given occasion, that does not mean we waive our right to enforce it later.
Severability: If any provision of this TOS is found unenforceable by a court of competent jurisdiction, that provision will be removed and the remaining provisions will continue in full force and effect.
Governing Law: This TOS is governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. You agree that any dispute arising from this TOS or your use of the Site will be brought exclusively in the state or federal courts located in Park County, Wyoming, and you consent to personal jurisdiction in those courts.
Assignment: You may not assign or transfer your rights under this TOS without our prior written consent. We may assign our rights and obligations under this TOS at any time without notice to you.
