Effective: September 1, 2026.

Welcome to ItalianCandy.Shop (the “Site”), an online store operated by Italian Candy Shop LLC (“us,” “we,” or “our”).

We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect through the Site, how we use it, and when we may share it with others. This Privacy Policy applies only to information we collect through the Site and does not cover information we might collect through other means.

This Privacy Policy, along with our Terms of Service and any other policies posted on the Site, governs your use of the Site. We may update this Privacy Policy from time to time without individual notice, so we encourage you to check back periodically. Any changes take effect as soon as the revised policy is posted. By continuing to access or use the Site after a change is posted, you agree to the updated Privacy Policy. If we intend to use personal information in a way that is materially different from what we described when we collected it, we will notify affected users by email and give them the opportunity to opt out of that new use.

A. Information We Collect

The Site generally collects two categories of information: (a) information that personally identifies you, and (b) information that does not, whether collected automatically or provided by you.

(1) PERSONAL INFORMATION

Personal information means information that can be used to identify or contact you, such as your name, mailing or shipping address, email address, phone number, or payment details. We do not automatically collect personal information simply because you browse the Site. We collect it when you choose to provide it, for example when you: (a) create an account or place an order, which requires your name, shipping address, email address, phone number, and payment information; (b) sign up for our email or SMS newsletter; (c) leave a product review or contact our customer care team; or (d) enter a promotion or giveaway we may run from time to time. Providing this information is your choice, though it is often necessary to complete an order or use the related feature.

(2) NON-PERSONAL INFORMATION

Non-personal information is information that does not identify you individually, including personal information that has been aggregated or de-identified. We automatically collect certain non-personal information when you use the Site, such as your IP address, browser type, device type, operating system, referring website, the pages you view, the search terms you use on the Site, and how long you spend on a given page.

B. How We Use and Share Information

(1) PERSONAL INFORMATION

We use the personal information you provide to fulfill orders, respond to inquiries, provide customer support, and otherwise carry out the purpose for which you gave it to us. We may also use it to send you order and shipping updates, and, if you have opted in, marketing emails or SMS messages about new products, promotions, or restocks. You can opt out of marketing communications at any time as described in Section H below; we will still send you transactional messages related to an order you have placed.

We share personal information with service providers who help us run the Site and fulfill orders, such as payment processors, shipping carriers, email and SMS marketing platforms, and website analytics providers. These providers are only permitted to use your information to perform services on our behalf. We do not sell your personal information to third parties for their own marketing purposes, and we will not share it with anyone else except as described in this Privacy Policy, as required by law, or with your consent.

(2) NON-PERSONAL INFORMATION

We use non-personal information to understand how visitors use the Site, improve our products and pages, and measure the performance of our marketing. We may combine non-personal information with information from other sources and may share it with service providers for these purposes, but this aggregated information does not identify you personally.

C. Other Uses and Information

(1) IP ADDRESSES

An IP address is a number automatically assigned to your device when you access the internet. Our servers log IP addresses for system administration, security, and to understand overall Site usage. We do not generally link IP addresses to your identity, but we reserve the right to do so if necessary to comply with the law, respond to a legal process, protect our rights or the Site, or address an emergency involving the safety of our users.

(2) COOKIES AND SIMILAR TECHNOLOGIES

Cookies are small text files a website stores on your device to remember your preferences and make the Site easier to use, such as keeping items in your cart between visits. We also use similar tools, like pixels, to understand how visitors interact with the Site and, if you have not completed a purchase, to send a reminder about items left in your cart by email or SMS if you have opted into those communications. This information does not typically identify you personally.

Most browsers let you block or delete cookies, and some let you send a Global Privacy Control or similar opt-out signal, which we will honor where required by law for cookies used for targeted advertising. Please note that some parts of the Site may not work properly if you disable cookies.

(3) EMAIL AND SMS COMMUNICATIONS

If you email us with a question or comment, we may use the personal information you provide to respond and may keep a record of the exchange for future reference. For your security, please avoid sending sensitive information, such as your full payment card number, by email. If you sign up for our email newsletter or SMS program, you will receive marketing messages until you opt out. You can unsubscribe from marketing emails using the link at the bottom of any such email, and from SMS messages by replying STOP to any text we send. We may still send you transactional messages, such as order confirmations or shipping updates, even if you have opted out of marketing communications.

(4) TRANSFER OF BUSINESS ASSETS

If Italian Candy Shop LLC is acquired by, merges with, or sells substantially all of its assets to another company, the personal information we hold may be transferred as part of that transaction. We will take reasonable steps to see that the acquiring party honors the commitments in this Privacy Policy. Personal information may also be considered a business asset in the event of a bankruptcy or similar proceeding.

(5) OTHER DISCLOSURES

We may disclose personal or non-personal information about you if required by law or legal process, or if we believe in good faith that doing so is necessary to comply with a government request, enforce our Terms of Service, protect our rights or property or those of our users, or respond to an emergency involving someone's health or safety.

(6) YOUR PRIVACY RIGHTS

Depending on where you live, you may have rights under state privacy laws, such as those in California, Colorado, Connecticut, Virginia, and elsewhere, to request access to, correction of, or deletion of the personal information we hold about you, or to opt out of certain uses of it. We do not sell personal information for money, and we do not otherwise sell or share it for cross-context behavioral advertising. To make a request, contact us using the information in Section H below; we may need to verify your identity before responding, and you may designate an authorized agent to act on your behalf where permitted by law.

California residents may also request, once per calendar year, a list of any third parties to which we have disclosed certain personal information for their own direct marketing purposes in the preceding year. You can send this request, along with your California address, to the address in Section H.

D. Product Reviews and Public Content

If the Site allows you to post a product review, comment, or similar content, anything you choose to share in that space is public and may be viewed by anyone, including people who do not follow this Privacy Policy. Please do not include personal information in a public review or comment that you would not want to be seen publicly. We are not responsible for how others use information you choose to post publicly on the Site.

E. Children

The Site is not directed at children, and we do not knowingly collect personal information from anyone under the age of 18. If you are a parent or guardian and believe your child has provided us with personal information, please contact us using the information in Section H, and we will take steps to delete it.

F. Keeping Your Information Secure

We use security measures we consider reasonable and appropriate to protect the personal information under our control from loss, misuse, or unauthorized access. That said, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. If we become aware that your personal information has been compromised in a way that requires notice under applicable law, we will notify you by email to the most recent address you have provided us, as promptly as reasonably possible under the circumstances.

G. Other Sites and Links

The Site may link to third-party websites that we do not control, including sites of shipping carriers, payment processors, or other businesses. We are not responsible for the privacy practices of any third-party site. We encourage you to review the privacy policy of any site you visit before providing it with personal information.

H. Contact and Opt-Out

If you have questions about this Privacy Policy, would like to correct information you have provided us, want to opt out of marketing communications, or want to exercise any privacy right described above, please contact us at:

I. Sole Statement

This Privacy Policy, as posted on the Site, is our sole statement of privacy practices for the Site. No summary, restatement, or other version of it is valid unless we post it to the Site as a new or revised policy.
